1. Agreement to Terms

These Terms of Use ("Terms") govern your access to and use of Chipr's app, connected devices, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms.

2. The Service

Chipr connects your sprinklers, hardware, mower, and smart assistant into one system for scheduling, monitoring, and automation. The Service includes our mobile and web applications, connected hardware you use with them, and any related support.

3. Accounts

You must provide accurate information when creating an account and keep your login credentials secure. You're responsible for activity that occurs under your account.

4. Hardware and Software

Any hardware you purchase is yours, subject to any applicable warranty terms provided at purchase. We grant you a limited, non-exclusive, non-transferable license to use our app and software solely to operate that hardware and access the Service.

5. Acceptable Use

You agree not to misuse the Service, including attempting to reverse-engineer our software, interfere with the Service's operation, or use it in a way that violates applicable law.

6. Third-Party Integrations

The Service may connect to third-party platforms such as Nest, Alexa, and Apple Home. Your use of those platforms is subject to their own terms and privacy policies, which we don't control.

7. Fees and Billing

If the Service includes paid features or subscriptions, applicable fees, billing frequency, and cancellation terms will be presented to you at the time of purchase.

8. Intellectual Property

Chipr and its licensors own all rights, title, and interest in the Service, including our software, trademarks, and branding. These Terms don't grant you any rights to our intellectual property beyond the limited license described above.

9. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We don't guarantee that the Service will be uninterrupted, error-free, or that it will prevent every possible hardware failure, leak, or yard issue.

10. Limitation of Liability

To the maximum extent permitted by law, Chipr will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Service, including property damage related to hardware malfunction, to the extent not caused by our gross negligence or willful misconduct.

11. Indemnification

You agree to indemnify and hold Chipr harmless from claims arising out of your misuse of the Service or violation of these Terms.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms.

13. Governing Law

These Terms are governed by the laws of the State of South Dakota, United States of America, without regard to its conflict-of-law principles.

14. Changes to These Terms

We may update these Terms from time to time. We'll post the updated version here and revise the "Last updated" date above.
